JUSTICE DINESH KUMAR SINGH ORAL ORDER 04/ 17-04-2017 Heard learned counsel for the petitioners and the learned counsel for the State.

The present application has been filed for quashing the order dated 10.02.2016 passed by learned District & Sessions Judge, Munger in Criminal Revision No. 71 of 2015 dismissing the revision application filed by the petitioners against the order dated 12.05.2015 passed by learned Sub-divisional Judicial Magistrate, Munger in Complaint Case No. 690C of 2010, whereby the petitioners' application for discharge under Section 245 Cr.P.C. has been rejected. Hence, the quashing of order dated

Patna High Court Cr.Misc. No.32333 of 2016 (4) dt.17-04-2017 2/2 12.05.2015 passed by learned SDJM, Munger in Complaint Case No. 690C of 2010 has also been prayed for.

It is submitted by learned counsel for the petitioners that the decree passed in Matrimonial Suit No. 110 of 2010 vide order dated 04.04.2012 was challenged by the complainant-O.P. No. 2, Amrita Kumari @ Amrita Devi in Misc. Appeal No. 534 of 2012 and the said appeal has been disposed of vide order dated 22.09.2016, whereby the Court quashed all the criminal cases pending between the parties.

In view of the order passed in Misc. Appeal the learned counsel for the petitioners seeks permission to withdraw this application since it has become infructuous. Accordingly, this application is dismissed as withdrawn.
