Petitioner seeks bail in a case registered for the offence punishable under Sections 8/20(b) (II) (c) /25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 Code. Earlier the bail application of the petitioner has been rejected by this Court as contained in Annexure 3. Allegation against the petitioner is recovery of 395 kg. Ganja from a truck which was being driven by the petitioner. It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 30.07.2017.
Considering the huge recovery of ganja, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for
Patna High Court CR. MISC. No.79559 of 2018(3) dt.12-03-2019 2/2 bail of the petitioner is hereby rejected.
However, the court below is directed to expedite the trial and conclude the same within one year from the date of receipt of the order.
