1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Adhaura P.S. Case no. 32 of 2022 registered under sections 25(1-B)(a), 26 and 35 of the Arms Act.

3. As per the prosecution case, the informant who happens to be the full brother of the petitioner states that two accused persons, both of whom are his brothers and one of them petitioner herein threatened to shoot him. The informant states that he went out along with his two wives. He gave information to the police station and on the next date on the police arriving at the house, they seized two guns from the petitioner.

4. Learned counsel for the petitioner submits that

No.24412 of 2023(2) dt.19-05-2023 2/2 the petitioner has been falsely implicated in the case as a result of family dispute between the brothers which is evident from the contents of the FIR itself. The allegation which is solely under the Arms Act, yet no FIR has been registered by the police authorities. The petitioner is in custody since 6.2.2023. He has no criminal antecedent and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations in the FIR, the petitioner having remained in custody since 6.2.2023, chargesheet having been submitted in the case and his not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Adhaura P.S. Case no. 32 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Kaimur at Bhabua.
