19-04-2016 Heard Sri Amarendra Kumar, learned counsel for the petitioner, Sri Dhurjati Kumar Prasad, learned Govt. Pleader - 7 as well as learned counsel who has appeared on behalf of respondent/Patna University.
The petitioner i.e. Patna University Employees Association has approached this Court invoking its writ jurisdiction, with a prayer to direct the respondents to grant benefit of A.C.P. scheme to the non-teaching employees of the Patna University in similar manner as State Government employees
Patna High Court CWJC No.16929 of 2011 (6) dt.19-04-2016 2/2 were being provided.
In this case, a supplementary affidavit has been filed on behalf of petitioner and in the supplementary affidavit, it has been indicated that the policy has already been taken to provide A.C.P. to its employees by the government, which has also been adopted by the Patna University, vide Annexure - 10 to the supplementary affidavit i.e. order contained in memo no. 622 dated 21-05-2015.
Learned counsel for the petitioner has raised a dispute that some of the members of the association have not been given such benefit.
Keeping in view the fact that prayer has been made for providing the benefit of A.C.P. to the employees of the Patna University, which has already been accepted, there is no reason to keep the matter further pending.
The writ petition stands disposed of.
It goes without saying that if individual member of the Association has any grievance, he/she would be at liberty to avail appropriate remedy.
