Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Begusarai (Town) P.S. Case No. 205 of 2022 registered for the offence under Sections 394/412 of the Indian Penal Code. As per the prosecution case, on 03.04.2022, at about 8.45 Hrs Ravi Anand and Himanshu Kumar has gone to Vishal Mega Mart and he was sitting in his vehicle which was parked in the stand. In the meantime, 3 to 4 person came and
Patna High Court CR. MISC. No.24304 of 2023(2) dt.19-05-2023 2/3 asked him to drop them to Khagaria upon which he replied that his vehicle was not for rent. Thereafter one person pressed his mouth and neck and forced him below the back seat and took the key of vehicle and all persons proceeded and after drive of 20-25 K.M., at one lonely place, they tied his hand and leg and left him. Then after seeing the patrolling vehicle of the police, he signaled and when they came then he disclosed the occurrence to the police and they brought him to Shahpur Kamal Police station.
Learned counsel for the petitioner submits that the petitioner is in custody since 21.11.2022.
Learned A.P.P. has vehemently opposed the prayer for bail.
The name of the petitioner has come on the basis of confessional statement of co-accused and he has clean antecedent and similarly situated co-accused has been granted bail vide order dated 23.09.2022 passed in Cr. Misc. No. 39010 of 2022 (Annexure-II).
Considering the aforesaid facts, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with
Patna High Court CR. MISC. No.24304 of 2023(2) dt.19-05-2023 3/3 two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Begusarai/concerned Court below in connection with Begusarai (Town) P.S. Case No. 205 of 2022. The petitioner will visit Muffasil Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
