JUSTICE RAVI RANJAN ORAL ORDER 01-07-2016 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in a case registered for the offences punishable under sections 341, 323, 307 and 379/34 of the Indian Penal Code.

It is contended that, as per the allegation, the informant's side was assaulted by the petitioners but no First Information Report was lodged against them rather a complaint case was filed which was later on sent to the police for investigation and there is no injury report to support the allegation. It is further contended that obviously there is a dispute between the parties for the post of "Sajjadanshi" of a Majar. It is also contended that the wife of the petitioner no. 1 also filed a complaint case against the informant's

Patna High Court Cr.Misc. No.26156 of 2016 (2) dt.01-07-2016 side which was later on sent to the police under section 156(3) of the Code for investigation. It is urged that the petitioners are having clean antecedents.

Having regard to the facts and circumstances of the case, let the abovenamed petitioners, namely, Sufi Ghulam Jilani, Md. Tabrej, Md. Parwej, son of Sufi Ghulam Jilani and Saira Bano @ Saira Khatoon, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Kanti Police Station Case No. 358/2015 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Muzaffarpur(West), subject to the conditions laid down under subsection (2) of Section 438 of the Code of Criminal Procedure.
