JUSTICE SATYAVRAT VERMA ORAL ORDER 10-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks regular bail in connection with Mohania P.S. Case No. 240 of 2020 instituted for the offences under Sections 399, 402, 408, 414, 411 and 216A of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 8, 20(b) II (B) and 27 (A) of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner is in custody since 06.08.2020 and charge-sheet has been submitted in the case.
Learned counsel for the petitioner submits that allegation is of recovery of a loaded country-made pistol from Vivek Kumar and one kg ganja from the vehicle in which the named accused persons were apprehended and the accused
Patna High Court CR. MISC. No.32559 of 2021(2) dt.10-01-2022 2/3 disclosed that this petitioner is the kingpin and purchases looted and stolen vehicles and this petitioner was earlier interrogated by the police who disclosed that he purchases stolen vehicle but was let off after inquiry but when the accused of the present case were apprehended, they disclosed the name of the petitioner as aforesaid and thus the petitioner came to be implicated in the present case and was apprehended. Learned counsel submits that earlier the petitioner was interrogated by the police but was not arrested and later when his name came based on the confessional statement of coaccused, the petitioner was made an accused in the present case. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 06.08.2020 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-Icum-Special Judge (NDPS Act), Kaimur at Bhabhua in connection with Mohaniya P.S. Case No. 240 of 2020 with a condition that one of the bailors shall be the father of the

No.32559 of 2021(2) dt.10-01-2022 3/3 petitioner and the petitioner will keep marking his attendance in the concerned police station in between 25-30 of every month commencing from January, 2022 till framing of charge and in the event, the concerned police station reports to the learned court below that the petitioner in any of the month in between the aforesaid said dates till framing of charge has not marked his attendance, the court below will be at liberty to cancel his bail bonds.
