In this case, the petitioners are seeking anticipatory bail in connection with Forbesganj P.S. Case No. 824 of 2018 (G.R. No. 3418 of 2018), registered for the offence under Sections 147, 148, 447, 341, 323, 325, 307, 354(B), 379, 504 and 506 of the Indian Penal Code.
Allegation has been made against the accused persons to have assaulted the informant and his family members by means of iron rod. It has also been alleged that petitioner no.1 inflicted iron rod blow upon the head of the informant and petitioner no.2 inflicted iron rod blow upon the Bhabho of the
Patna High Court CR. MISC. No.21868 of 2019(2) dt.08-04-2019 2/2 informant.
Learned counsel for the petitioners submits that the incident took place on account of land dispute. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court. While deciding the bail petition, the Court below will also consider the fact that other co-accused persons have been granted bail.
