JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through the virtual Court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 60.375 litres of liquor from an auto.

Learned counsel for the petitioners submits that the petitioners are in custody since 04.01.2022, charge-sheet has been submitted and are persons with clean antecedent. Learned

Patna High Court CR. MISC. No.24134 of 2022(2) dt.20-05-2022 2/2 counsel further submits that the petitioners are passengers and, as such, were not aware what was kept in the auto. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody since 04.01.2022, charge-sheet has been submitted and are persons with clean antecedent, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.1,000/- (Rupees One Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Jagdishpur (Bypass) P.S. Case No. 06 of 2022.
