The petitioner seeks bail in connection with Sonpur P.S. Case No. 308 of 2020 registered for the offence under Section 304B, 201 and 34 of the Indian Penal Code. As per the prosecution story in short is that one Munni Devi gave a written application that her sister married on 02.12.2010 according to Hindu rites and custom with Vikram Aditya after registering the land 1 kaatha 8 dhur on demand which was in the name of mother and grandmother of informant. Informant's sister (Deceased) was tortured by husband, Father-in-law and Brother-in-law from beginning of
Patna High Court CR. MISC. No.24286 of 2023(2) dt.19-05-2023 2/3 marriage to bring money after selling land. In the meantime, informant's sister gave birth to one son namely Dhruv Kumar aged 5 years and one daughter namely Kittu Kumari aged 3 years. Informant talk to her sister every day. On 18.04.2020 she was talking to her sister but on 19.04.2020, mobile was switched off. When informant went to house of her sister with her child then she found that her sister was not there. Son and daughter of her sister was also not there.
Learned counsel for the petitioner submits that the petitioner is in custody since 04.02.2023 and the petitioner is nephew of husband of deceased and the petitioner is quite innocent and has committed no offence and he has been falsely been implicated in this case only on the basis of being relatives of the husband of deceased.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the fact that the petitioner is nephew of husband of deceased, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the
