2. The petitioner apprehends his arrest in a case registered for the offence under Sections 303(2), 317(2) of the Bhartiya Nyaya Sanhita, 2023 and Section 194 of the Motor Vehicls Act, 1988.

3. As per the prosecution case, petitioner is owner of the truck, which was seized while transporting the sand. It is alleged that without having valid challan, same was being transported by the driver.

4. Learned senior counsel for the petitioner submits that petitioner is innocent and has committed no offence. The truck in question was having valid challan. In support of the same, learned senior counsel for the petitioner has attached a

Patna High Court CR. MISC. No.24581 of 2025(3) dt.23-06-2025 2/2 copy of report dated 07.02.2025, issued by Mining Office, Rohtas (Annexure P/3) and submits that the challan, produced by the petitioner, was issued on 02.01.2025. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Dehri, Rohtas (Sasaram) / concerned Court in connection with Darihat P.S. Case No. 01 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
