2. Petitioner seeks bail who is in custody since 30.01.2024 in connection with Hathaudi P.S. Case No. 68 of 2022, F.I.R. dated 07.05.2022 for the offences punishable under Sections 363 and 366-A of the Indian Penal Code.

3. Earlier the petitioner has been granted anticipatory bail by this Court vide order dated 02.04.2024 passed in Cr. Misc. No. 18325 of 2024.

4. From perusal of the aforesaid order dated 02.04.2024 it appears that the learned counsel for the petitioner

Patna High Court CR. MISC. No.25397 of 2025(4) dt.01-08-2025 2/3 has made submission that the petitioner has performed marriage with the victim. The Court has not called for the case diary as well as statement of the victim recorded under Section 164 of the Cr.P.C. / Section 183 of the BNSS and has allowed bail to the petitioner.

5. Vide order dated 20.06.2025 the Court has called for the case diary, statement of the victim recorded under Section 164 of the Cr.P.C. / Section 183 of the BNSS as well as medical report.

6. From perusal of the statement of the victim recorded under Section 164 of the Cr.P.C. / Section 183 of the BNSS which was recorded on 06.12.2023 it appears that the petitioner has kidnapped the victim and regularly committed rape upon her and she has supported the case of the prosecution and on the date of occurrence the victim was minor.

7. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case.

8. Learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.

9. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection
