2. The petitioner has preferred this application for grant of regular bail in connection with Amdabad P.S. Case No. 03 of 2025 dated 05.01.2025 registered for the offences punishable u/ss 103(1), 61(2) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, on 04.01.2025, the coaccused, Sugan Mandal called the informant's son namely, Chandan Yadav and took him from his house and his son did not return in the night. On 05.01.2025, the informant received an information that his son was brutally assaulted by the petitioner and the co-accused persons and they threw him in a field

The informant went there and at that time, his son was taking breath and thereafter, he took him to the hospital where the doctor declared him dead. It is further alleged that the informant apprehends that accused persons killed his son under a conspiracy because his son demanded his wage of Rs. 20-22 thousand from the co-accused, Sugan Mandal and due to demand of the said amount, the accused persons killed his son.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The specific allegation is against the co-accused, Sugan Mandal and Chotu Mandal who called the informant's son and they took him from his house. The petitioner has been made accused in this case only because he is the brother of the co-accused, Sugan Mandal. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 06.01.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.25618 of 2025(2) dt.13-05-2025 3/3 of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar in connection with Amdabad P.S. Case No. 03 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

7. The application stands allowed.
