The petitioner, who is in custody since 23.08.2019 and claims to be a person of clean antecedent, seeks bail in connection with Barauni (Chakiya) P.S. Case No. 359 of 2019, dated 22.08.2019, instituted for the offences under Sections 353 and 307 of the Indian Penal Code and Sections 25(1-b)a, 26 and 27 of the Arms Act.

The petitioner is said to have been arrested with a loaded country made pistol. Firing is also stated to have been resorted to by the miscreants but, admittedly, nobody

It has been submitted on behalf of the petitioner that the recovery of the firearm weapon is a sham. In fact, the petitioner is a farmer and for some reason or the other, he has been falsely implicated in this case by the police. Considering the facts afore-stated and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Begusarai in connection with Baranui (Chakiya) P.S. Case No. 359 of 2019 (G.R. No. 3044/2019).

The application stands allowed.
