Petitioners seek pre-arrest bail in Bheja P.S.Case No.49/18 registered under Sections 109, 147, 148, 149, 188, 341, 323, 353, 504, 506/34 of I.P.C.
Allegation against the petitioners and others is of blocking the vehicle of the S.D.O. with some complaints. Submission on behalf of the learned counsel for the petitioners is that no allegation of assault or abuse has been attributed against the petitioners. They have got no criminal antecedent.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.1335 of 2019(2) dt.18-01-2019 2/2 circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M.-III, Jhanjharpur, Madhubani, in Bheja (Madhubani) P.S.Case No.49 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that the bailors must be of local having sufficient movable and immovable properties within the jurisdiction of the court concerned.
