JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with S.Tr. No. 592 of 2005, arising out of Bakhri P.S. Case No. 30 of 2001, for the offence under Sections 144, 379, 427 and 307 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner was earlier granted bail, however, his bail bonds was cancelled for lack of Pairvi. He further submits that for 14 long years, the petitioner attended the Court and when there was no progress in the case he left for another State to earn bread and butter and subsequently his bail bonds was cancelled. He further submits that the petitioner was apprehended after cancellation of bail bonds on 31.08.2018.
Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.1545 of 2019(2) dt.06-02-2019 2/2 the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Begusarai in connection with S.Tr. No. 592 of 2005, arising out of Bakhri P.S. Case No. 30 of 2001, subject to the condition that the petitioner shall extend full co-operation in the trial of the case. In the event, the petitioner is involved in delaying the trial, the trial court shall be at liberty to cancel his bail bonds.
