====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 29-04-2024 Heard learned counsel for the petitioner and learned A.P.P for the State along with learned counsel for the informant.

2. The petitioner has preferred this application for grant of regular bail in connection with Nawkothi P.S. Case No. 137 of 2023 dated 06.10.2023 registered for the offences punishable u/ss 341, 323, 325, 307, 504 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, it is alleged that Nand Kishore Yadav and Rajendra Yadav along with three unknown persons have surrounded the husband of the informant. It is further alleged that they have assaulted Manoj Yadav, husband of the informant by iron rod causing head and nose injuries.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.26342 of 2024(2) dt.29-04-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case due to land dispute. The petitioner has no concern with the alleged occurrence. There is case and counter-case between the parties. The petitioner has clean antecedent as stated in para 3 of the bail petition. There is general and omnibus allegation against the petitioner. The petitioner is in custody since 17.01.2024.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner and submitted that the injury of the injured is grievous.

6. Considering the aforesaid facts and circumstances of the case and submissions made by learned counsel for the parties, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Nawkothi P.S. Case No. 137 of 2023.

7. The application stands allowed.
