JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 This is an application for grant of anticipatory bail in connection with Rupaspur P.S. Case No. 309 of 2018, disclosing offences under Sections 406 & 420 of IPC.

Prosecution story as per written report is that petitioners have requested to purchase the land from them and the informant has paid Rs.5,00,000/- to the petitioner no.1 and Rs.8,00,000/- to the petitioner no.2 through RTGS, and altogether they have taken Rs.42,00,000/- but no agreement for sale was executed and they have not paid any money.

No.22179 of 2019(5) dt.05-07-2019 2/3 After some arguments, learned counsel for the petitioners has stated that they are ready to return the said money if some reasonable time is given to the petitioners. On the other hand, learned counsel for the the opposite party no.2 has no objection for the same. In such view of the matter, let the petitioners, above named, surrender before the learned court below within a period of six weeks from the receipt of this order with a bank draft of Rs.1,00,000/- payable in the name of Rahul Kumar and a bank draft of Rs.2,00,000/- in favour of Santosh Kumar. Once the same is deposited, they will be enlarged on provisional bail for a period of four months. During that period, they will pay the amount of Rs.4,00,000/- in four equal installments to Rahul Kumar by bank draft and amount of Rs.6,00,000/- to Santosh Kumar within a period of four months in four equal installments. Once the total amount is paid, their bail bonds shall be confirmed.

If the complainants filed separate applications before the court below for release of the amount, the same shall be released in their favour on filing their undertakings to abide by final outcome of the case.

Once the amount is not deposited within the period
