JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 18-08-2015 In the present application filed under Articles 226 and 227 of the Constitution of India, the challenge is to the first information report of Hajipur Town P.S. Case No. 127 of 2011 dated 8.3.2011 registered under Section 304 of the Indian Penal Code.
It has been brought to my notice that after completion of investigation, the investigating agency has already submitted report under Section 173 of the Code of Criminal Procedure before the Magistrate concerned.
In view of the subsequent development, which took

WJC No.576 of 2014 dt.18-08-2015 2 / 2 place during pendency of the application, the application is disposed of with liberty to the petitioner to take appropriate action in accordance with law if on perusal of the police report, the learned Magistrate takes cognizance of the offence and summons the petitioner to face trial.
