====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Bhairabsthan P. S. Case No.139 of 2020, instituted for the offences under Section 379 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 21.01.2021, he is a person with clean antecedent and charge-sheet has been submitted against him.

The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that on

No.33957 of 2021(2) dt.01-12-2021 2/3 09.09.2020, when the informant with his daughter were returning to their house on a Hero Glamour motorcycle and when they reached near West to Kamala Balan bridge, the handbag of the daughter fell as a result of which, the motorcycle was stopped in the meantime, two culprits coming from behind took the motorcycle of the informant towards Samiya.

The learned counsel for the petitioner submits that he had purchased this stolen motorcycle from Chandan Yadav as the petitioner was not knowing that it was stolen motorcycle and Chandan Yadav assured that he will be providing the documents relating to the said motorcycle later.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 21.01.2021, he is a person with clean antecedent and charge-sheet has been submitted against him, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the
