Having regard to the nature of allegation for offence under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code, this Court, keeping in view of the specific allegation against the petitioner of throttling the injured by neck, is not inclined to grant privilege of anticipatory bail.
That being so, the prayer for anticipatory bail of the petitioner, namely, Chhotka Jaghua is rejected but, then, nothing said in this shall come in the way of the petitioner if he surrenders and makes a prayer for regular bail which of-course shall be considered on its own merit without being prejudiced by anything said in this order.
