The petitioner seeks bail in Excise Case No. 1292 of 2018 arising out of Ara Mufassil P.S. Case No. 266 of 2018, instituted for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act, 2016.

Counsel for the petitioner submits that petitioner is in custody since 5.11.2018. He has not been apprehended on spot. The name of this petitioner has been disclosed by Ravindra Kumar Yadav and Satyendra Prasad Chandravansi who were apprehended by the police. Counsel for the petitioner further submits that co-accused Satendra Prasad Chandrabansi @ Satendra Prasad and Ravindra Kumar Yadav have been

Patna High Court Cr.Misc. No.79093 of 2018(2) dt.16-01-2019 2/2 granted bail by coordinate Benches of this Court vide orders dated 12.10.2018 and 6.10.2018 passed in Cr. Misc. 63030 of 2018 and 61935 of 2018 respectively.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhojpur, Ara, in connection with Excise Case No. 1292 of 2018 arising out of Ara Mufassil P.S. Case No. 266 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
