JUSTICE MIHIR KUMAR JHA ORAL ORDER 03-09-2015 This case has been listed under the heading 'To Be Mentioned' at the instance of the learned counsel for the petitioner pointing out that there is typographical error in page-2 in the second para where depositing of cheque has been shown to be made 'by the petitioner in the Bank' whereas the facts remains that the said cheque shall be deposited by the informant. Learned counsel for the petitioner seems to be correct and, therefore, the word 'petitioner' in the 4th line of page-2 shall be read as 'O.P. No. 2'.
Learned counsel for the petitioner also points out that the name of the O.P. No. 2 has not been incorporated in the petition and so in the order sheet though the O.P. No. 2 had appeared and was heard on different dates as a follow up measure
Patna High Court Cr.Misc. No.50455 of 2014 (5) dt.03-09-2015 2/2 of the mediation, which was held under the order of this Court dated 27.04.2015.
In that view of the matter, this Court would give permission to the learned counsel for the petitioner to add O.P. No. 2 in the cage column of the application.
