The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 341/323/307/504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that dispute arose on account of demand being between the brothers for a share in the family property. He further submits that on account of such demand being made by them, there was provocation which led to the occurrence. The injuries purported to have been inflicted by the petitioners have been found to be simple in nature. Considering the nature of allegations and that the parties are closely related and belong to the same family and that there is one other case in between the same parties, let the
Patna High Court Cr.Misc. No.27655 of 2016 (2) dt.04-08-2016 P2/2 petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 45/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
