The Petitioner apprehends his arrest in Amas P.S. Case No.125 of 2015 instituted for the offence under Section(s) 414 Indian Penal Code and Section 20/22 of the NDPS Act pending before the Additional Sessions Judge, II, Gaya. It is alleged that 80 Kg. Ganja, 2 Kg. Opium, and 40 Gram Doda was recovered form the truck bearing registration no. PB 23F /8517 near Sherghati, Gaya.

The petitioner is, admittedly, the owner of the truck. The driver was caught at the spot by the police. The witnesses in para 2, 3, 5, 6 have supported that huge quantity of contraband have been recovered from the truck

Patna High Court Cr.Misc. No.34526 of 2016 (3) dt.23-01-2017 2/2 of this petitioner.

In view of such, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. Prayer is rejected.

The petitioner may surrender and seek regular bail, which shall be considered and disposed off on its own merit without being prejudiced by this order.
