Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in a case registered for the offence under Sections 304(B) and 201/34 of the I.P.C. The prosecution story, in brief, is that the accused persons including the petitioner committed murder of the daughter of the informant due to non-fulfilment of demand of dowry.
Earlier the bail application of the petitioner was rejected vide Cr. Misc. No. 8329 of 2019 dated 01.07.2019,
Patna High Court CR. MISC. No.26230 of 2020(3) dt.01-02-2021 2/2 annexed as Annexure-1 to the present bail application, taking into account that the petitioner is the husband of the deceased and onus is upon him to explain the cause of death of his wife. A report was called for from the court below regarding the stage of the case. It has been reported that out of five charge sheet witnesses, evidence of one witness has already been examined.
Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Garkha P.S. Case No 39 of 2017, pending in the court of learned VIIIth Additional Sessions Judge, Saran, Chapra.
The court below is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of copy of this order. (Sudhir Singh, J) U.K./- U T
