JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-12-2023 Heard Mr. Yogesh Chandra Verma, learned Senior Advocate for the petitioner and Mr. Mritunjay Kumar, learned Advocate for the informant. The State is represented by Mr. Jay Naraian Thakur, learned APP.

2. The petitioner seeks bail in connection with Sessions Trial No. 587 of 2019 arising out of Khodawandpur P.S. Case No. 165 of 2019 instituted for the offences under Sections 120(B), 302, 201/34 of the Indian Penal Code.

3. The prayer for bail of the petitioner has been rejected twice; the last time being on 11.05.2022 in Cr. Misc. No. 5819 of 2022.

4. This Court had called for a report about the stage of the case from the court below. The report dated 18.09.2023 indicates that out of 12 charge-sheet witnesses, eight have already been examined, crossexamined and discharged. There is every likelihood of the trial being concluded in near future.

5. Taking into account the accusation against the petitioner and the fact that the trial is almost at the end, this Court is not inclined to re-visit the order refusing bail to the petitioner.

6. Accordingly, the prayer for bail is rejected.

7. However, it is expected that the Trial Court shall positively conclude the trial within next four months.

8. With the aforesaid direction, the petition stands disposed of.
