JUSTICE RAKESH KUMAR ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner, learned AC to SC-30 as well as learned counsel, who has appeared on behalf of Respondent/ Accountant General, Bihar.

The petitioner, who superannuated on 31.01.2008, has approached this Court by filing the present writ petition in the month of September, 2011 primarily with a prayer to direct the Respondents to shift his date of first time bound promotion from 12.03.1987 to 01.04.1981.

In this case, a counter affidavit was filed on behalf of the Accountant General and it has categorically been stated that

Patna High Court CWJC No.15935 of 2011 (5) dt.12-04-2016 2/2 after retirement, pensionery benefit has already been authorized. Keeping in view the fact that three years after retirement, the petitioner has virtually questioned the first time bound promotion, which was issued long back, the Court is of the opinion that after lapse of about 30 years, such dispute may not be reopened.

The writ petition stands dismissed.
