2. Considering the calculation provided by the petitioner in Annexure-2 to the rejoinder filed on behalf of the
Patna High Court CWJC No.6705 of 2019 dt.13-07-2023 2/2 petitioner. The Nagar Parishad must verify the chart and make payment of the retiral dues as claimed by the petitioner in accordance with the law. In case, the petitioner has not been paid.
3. The Municipal Commissioner, Samastipur in case finds that the chart as prepared by the petitioner for claiming retiral dues on different heads has already been paid or not paid is required to notice the petitioner and provide him proper opportunity to place his case and then take a final decision to make payment of all the retiral dues in accordance with law within a period of four weeks from the date of passing of this order. In case of failure, the petitioner is at liberty to take appropriate legal action against the Municipal Commissioner, Samastipur.
4. With the above observations and directions, the present writ petition stands disposed of.
