1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Ramgarh (Nuaon) P.S. Case no. 281 of 2022 registered under section 379 of the Indian Penal Code.

3. As per the prosecution case, the motorcycle of the informant was stolen.

4. It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in course of investigation when he was falsely implicated in another case and the recovery of the motorcycle of the present informant shown to have been made from this petitioner. No incriminating article has been recovered from the possession of the petitioner

Patna High Court CR. MISC. No.25506 of 2023(2) dt.19-05-2023 2/2 who is in custody since 21.9.2022. Charge sheet has been submitted in the case.

5. Heard learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the material on record, the submissions made on behalf of the petitioner, the petitioner having remained in custody for over seven months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Ramgarh (Nuaon) P.S. Case no. 281 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Mohania, Kaimur (Bhabua).
