Mr. Rajani Kant Singh, learned counsel for the petitioner seeks permission to withdraw the application with respect to petitioner no. 1 who has been arrested. The application with respect to petitioner no. 1 is dismissed as having become infructuous.
The petitioner no. 2 seeks bail in anticipation of his arrest in connection with Tilauthu P.S. Case No. 66 of 2018 dated 22.09.2018 instituted for the offences under Sections 341, 323, 379, 447, 307, 504, 506 and 34 of the Indian Penal Code.
The petitioner no. 2 along with others is said to have indulged in assault on the informant and his family
Patna High Court Cr.Misc. No.79916 of 2018(2) dt.17-01-2019 2/2 members. The allegations are general and omnibus in nature and the parties are agnates. The injuries suffered by the victims of the occurrence are stated to be simple in nature.
Considering the aforestated facts as also taking into account that the petitioner no. 2 does not have any criminal antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas in connection with Tilauthu P.S. Case No. 66 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
