The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 120B and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant was regularly beaten up by the husband and others. It is stated that after some time, she could not be contacted on her mobile phone as the same was coming as switched off. Subsequently, a dead body was recovered.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. His name transpired in the alleged confessional statement made before the police. It is submitted that even accepting the allegations in the said

Patna High Court CR. MISC. No.32274 of 2021(3) dt.20-01-2022 2/2 confessional statement, the petitioner is not stated to be the assailant of the deceased. The petitioner is in custody since 19.1.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the material that has transpired in course of investigation and the petitioner having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Rauta P.S. Case no. 87 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea.
