2. In the present case, the petitioner seeks bail in connection with G.R. No. 2955 of 2025, arising out of Rajoun P.S. Case No. 328 of 2025 dated 27.08.2025, registered for the offences punishable under Sections 103(1), 305 and 3/5 of the B.N.S., 2023.

3. As per the prosecution case, six unknown persons entered into the house of the informant and assaulted her husband demanding documents of property and when he refused, he was strangulated to death. The informant named a number of persons with whom there was dispute over land. The miscreants took away mobile phones, ATM cards, property papers, Aadhar card, PAN card, passbook, jewelry, cash etc. from the house of the informant. The name of the petitioner

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. The name of the petitioner sprung up in the present case on saying of the informer. But the petitioner has been falsely implicated in this case in order to save the real culprits. Thereafter the petitioner was apprehended and his confessional statement was recorded. The petitioner confessed his guilt and also named the co-accused Ashish Yadav for being involved in the occurrence. Ashish Yadav has been granted anticipatory bail by a learned co-ordinate Bench of this Court vide order dated 12.05.2026 passed in Cr. Misc. No. 10386 of 2026. Learned counsel next submits that there is no independent witness to the alleged occurrence and till date no test identification parade has been conducted. Learned counsel further submits that petitioner is having antecedent of two cases and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 30.11.2025.

5. Learned A.P.P. appearing on behalf of the State opposes the submissions made on behalf of the petitioner and submits that at the instance of the petitioner recovery of articles

6. Having regard to the fact that recovery of looted articles belonging the deceased have been made at the instance of the petitioner and also considering the gravity of the offence and nature of allegation, I am not inclined to enlarge the petitioner on bail.

7. Accordingly, the prayer for bail of the petitioner stands rejected.
