JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 05-02-2019 This is an appeal under Section 14A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer of anticipatory bail dated 27.11.2018 passed by the learned Addl. Sessions Judge-1st, Supaul in ABP No. 1351 of 2018 arising out of Supaul Mahila P.S.Case No. 203 of 2017 registered under Sections 307, 366 and 376D of the Indian penal Code and Sections 3(1)(w)(i) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Allegation against the appellant is of committing rape upon the informant and the same is found corroborated from the statement of victim girl recorded under Section 164 Cr.P.C. Submission of learned counsel for the appellant is that

Patna High Court CR. APP (SJ) No.4851 of 2018 dt.05-02-2019 2/2 medical report does not support the allegation of rape for which he has falsely been implicated.
