2. The petitioner seeks bail in connection with Barauni P.S. case No. 151 of 2017 instituted for the offences under Sections 387, 307, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. Prosecution case, in short, is that when the informant alongwith his friend was going to Khodawanpur by Bolero vehicle, on the way, three co-accused persons came on

No.29271 of 2024(2) dt.20-04-2024 2/3 motorcycle armed with pistol and asked the informant why he has not paid the ransom amount of rupees ten lakhs as demanded by Ajit Singh (petitioner). However, when the informant drove the vehicle fast, all the three accused persons started firing indiscriminately upon the informant.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. The name of the petitioner has been disclosed by the co-accused Kundan Kumar who has already been granted bail by the coordinate Bench of this Court vide order dated 12.09.2017 passed in Cr. Misc. No. 39407 of 2017. He further submitted that the petitioner has not taken active part in the alleged crime as he was in jail at the relevant date and time of the occurrence. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.05.2017 and has twenty-seven criminal antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, nature of offence as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail, after framing of charge, if not already framed, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Barauni P.S. case No. 151 of 2017.
