The petitioner apprehends his arrest in connection with Turkaulia (Banjaria) P.S. Case No. 557 of 2014 registered under Sections 366(A), 372, 506/34 of the Indian Penal Code. The accusation is of kidnapping of minor daughter of the informant by the petitioner and three others. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. The statement of victim recorded under Section 164 Cr. P.C. on 20.08.2014, in which she stated that she was taken by co-accused Jalil Miya, Makaiya Babu and Sita

Patna High Court Cr.Misc. No.33288 of 2016 (2) dt.20-08-2016 2/2 from her house and giving threatening to kill her, if raised hulla and the petitioner has no role in kidnapping the victim. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Motihari, East Chapmparan in connection with Turkaulia (Banjaria) P.S. Case No. 557 of 2014, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
