The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard both parties.

The following reliefs have been sought for on behalf of the petitioner in the present writ application :

Patna High Court CWJC No.7230 of 2019(6) dt.24-09-2020 2/3 1(i) For revision of family pension of the petitioner which has been fixed against Level11 scale by the Accountant General vide letter dated 10.11.2017 fixing family pension of the petitioner to be Rs.22860/- w.e.f. 01.01.2016. (ii) To declare that the petitioner is entitled to have her family pension fixed on the basis of pay drawn by her deceased husband in I.A.S.

cadre and pay protection that he received prior to promotion from State Civil Services to I.A.S. Cadre. By removing anomalous situation whereby pension/family pension has been reduced after promotion to the higher posts.

(iii) For a direction upon the Respondents to grant additional quantum of pension of 40% as per decision of the department of public grievance and pension w.e.f. the date the petitioner attained 90 years of age i.e. w.e.f. 15.11.2018.

Mr. Anand Kumar Ojha, learned counsel appearing on behalf of the petitioner, submits that most of the grievances of the petitioner has already been redressed. If any grievance is still to be redressed by the concerned authority, the petitioner shall make a representation before the Respondent No.2, who shall consider the same and pass an appropriate order in accordance with law within a period of four months from the date of filing of such representation.
