JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 379, 354, 504, 506/34 of the Indian Penal Code.
It is alleged that the petitioner along with other accused persons assaulted the informant, mother-in-law and gotani. It is further alleged that co-accused Ranjeet Sahani snatched golden mangal sutra from the neck of the informant. It is submitted on behalf of the petitioner that specific allegation of assault is against co-accused Indradeo Sahani. So far as this petitioner is concerned, there is general and omnibus allegation against him and no specific overt-act is leveled

Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Sarai P.S.
