The petitioner apprehends his arrest in Mirganj P.S. Case No. 195/2015, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. Amreshwar Tiwari named the petitioner along with other accused persons. The petitioner is alleged to have fired Anil Tiwari, but the shot did not hit Anil Tiwari. It is submitted that there is no allegation of assault against the petitioner. The case has not been registered under any of the sections of the Arms Act. Similarly situated co-accused Manoj Tiwari and others have been granted anticipatory bail vide order dated 09.11.2015 passed in Cr. Misc. 51154/2015. The case of the petitioner stands on the same footing.

No.26114 of 2017 (2) dt.13-07-2017 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Mirganj P.S. Case No. 195/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
