The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that her younger son had gone with his friends including the petitioner herein. He did not return and search started. Thereafter it is stated that on information having been received from Chhotu Sahani, the dead body of the informant's son was recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. In

Patna High Court CR. MISC. No.24260 of 2022(3) dt.12-01-2023 2/2 course of investigation Chhotu Sahani was taken into custody and his confession was recorded, wherein he has taken the name of both Krishna Saw as also the petitioner herein. The said Krishna Saw has been enlarged on bail. No other material has transpired in course of investigation to connect the petitioner with the alleged crime. The petitioner is in custody since 25.11.2019 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, grant of bail to co-accused Krishna Saw, the petitioner being in custody for more than 3 years since 25.11.2019 and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Alamganj P.S. Case no. 877 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Patna City, Patna.
