2. The petitioner apprehends arrest in connection with Darbhanga Sadar P.S. Case No. 103 of 2022 dated 01.03.2022, instituted for the offence punishable under Sections 420, 406, 467, 468 and 471 of the Indian Penal Code.
3. The prosecution case, in short, is that the informant (wife of Ranvir Singh) is a Director of GRV Intelligence Security Force Pvt. Ltd. having its corporate office at G-7, Arunachal Building, 10 Barakhamba Road, Connaught Place, New Delhi. The informant alleged in her written application that the accused-petitioner Pramod
2/4 Kumar was sent to Darbhanga on 21-09-2019 for looking after the affairs of the company. It is further alleged that during the period of sixteen months the accused petitioner misappropriated Rs.71,68,647/-, which was sent to him in different modes. He was called to give details of the expenses but he did not come. The aforesaid amount comprises of salary of security guards and cost of uniform etc.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that the petitioner was working as an Advocate Clerk with an Advocate in Supreme Court of India and now he is practicing as an Advocate in the same place. It is submitted that the petitioner was granted anticipatory bail by the Additional Sessions Judge-IIIrd, Darbhanga on 02.12.2023 vide A.B.P. No. 1279 of 2023 till filling of the charge-sheet and now charge-sheet has been filed against the petitioner. Hence, the present application has been filed for granting anticipatory bail of the petitioner. It is submitted that earlier University P.S. Case No. 270 of 2021 was filed by the petitioner against husband of the
3/4 informant with regard to assault by henchmen of the husband of the informant, namely, Ranvir Singh and for taking signature of the petitioner on blank papers and threatening to kill him. It is also submitted that the husband of the informant is a notorious criminal and he is an accused in nine criminal cases in Silvasa at Dadar & Nagar Haveli and an internment order was also passed by the Collector, Silvasa, dated 05.08.2017 and only in that connection he went to the office of the petitioner for filing his case in the Supreme Court. Over a period of time, the petitioner and the said Ranvir Singh (husband of the informant) came close to each other and Ranvir Singh gave offer to the petitioner to start a business of Security Guard in Darbhanga. It is also submitted that the petitioner started the same business in Darbhanga due to which present false case has been lodged by the wife of Ranvir Singh. Lastly, it has been submitted that he has no criminal antecedent.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the
4/4 parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Darbhanga Sadar P.S. Case No. 103 of 2022, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga, subject to condition as laid down under Section 438(2) of the Cr.P.C..
