2. The petitioner makes a prayer for bail in connection with Basmatiya P.S. Case No.19 of 2025, F.I.R dated 16.03.2025 registered for the offences punishable under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, in brief, is that the informant, Ramashankar Uraon, alleged in his written information dated 16.03.2025 that on 15.03.2025 at about 9/10 PM, while searching for his wife, Hiriya Devi, he found her dead body lying in a maize field situated south of his house. He alleged that due to a land dispute, the accused persons namely

Patna High Court CR. MISC. No.24351 of 2026(3) dt.13-05-2026 2/3 Heeralal Uraon, Tunnu Uraon, Lattu Uraon, Mithun Uraon, Srilal Uraon, Binod Uraon, Mahendra Uraon, Buddhiman Uraon and Shiv Narayan Mandal had killed her.

Learned counsel for the petitioners submits that the petitioner is not named in the F.I.R and initially 9 persons were implicated for the alleged offence and in re-statement, there was also no change in version which was recorded in the F.I.R. but thereafter, on return of the son of informant, the petitioner, along with other accused persons, have been implicated in the present case and based on such statement, he has been taken into judicial custody. It has next been submitted that the there is no eye-witness to the said incident and the petitioner having no criminal antecedent, is lying in jail since 16.01.2026.

5. Learned Additional Public Prosecutor for the State opposes the prayer for regular bail.

Considering the facts and circumstances that there is no eye-witness to the said incident and the petitioners have been implicated in the present case along with other accused persons, solely on the basis of the subsequent statement and petitioners having no criminal antecedent, are languishing in jail since 16.01.2026, let the petitioners be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of
