1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Bhagwanpur Hat P.S. Case no.221 of 2021 registered under sections 341, 323, 324, 379, 504, 506 and 34 of the Indian Penal Code.
3. As per the prosecution case, the accused persons including the petitioner herein are said to have come variously armed and resorted to hurling abuses. It is further stated that Ashique Hussain came armed with a country made pistol and threatened the informant. The petitioner came with a knife and assaulted the nephew of the informant namely Sheikh Gulam Kausar, injuring him.
4. It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.25458 of 2023(2) dt.19-05-2023 2/2 that the petitioner has been falsely implicated in the case due to previous family dispute among the family members. The so called injury attributable to the petitioner has been found to be simple in nature as per the injury report brought on record as Annexure-3 to the application. The petitioner is in custody since 7.2.2023 and charge-sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the injury attributable to the petitioner having been found to be simple in nature together with the petitioner having remained in custody since 7.2.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Bhagwanpur Hat P.S. Case no.221 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Siwan.
