JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-12-2020 Heard learned counsel for the petitioners and learned APP for the State through virtual court proceedings. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 366(A) of the Indian Penal Code.

Prosecution case in brief is that on 03.12.2019 the informant claimed that his daughter namely Reshma Kumari aged about 16 years has been kidnapped by Manish Kumar and he informed through mobile phone and said that his daughter was going to marry with him. After that he went to the house of Manish Kumar and told his parents that why Manish did so then

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. The statement of the victim recorded under Section 164 Cr.P.C. in the court of learned Judicial Magistrate-1st Class, Nawada where she has clarified that no one has kidnapped her rather she had gone and solemnized marriage algonwith Manish Kumar as per her own wish since her parents were going to sell her for marry in the hand of one more aged person so she decided to do so. He further submits that the petitioners are family members of co-accused namely Manish Kumar. The petitioners have got no criminal antecedent which is mentioned in para 3 of the bail petition.

Learned APP for the State opposes the prayer for bail petition.

In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (rupees twenty five
