The petitioner has preferred this application for grant of regular bail in connection with Bhangaha P.S. Case no. 65 of 2022 registered under sections 304B and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant was married to the son of the petitioner. It is stated by the informant that his daughter used to communicate about being assaulted by her husband for non-fulfillment of the demand of dowry. The informant received information that she had hung herself. The informant states that he is convinced that the accused persons including the petitioner herein have a hand in the murder of his daughter.

The allegations in the FIR are false and concocted. The husband of the deceased is in custody. The petitioner is in custody since 18.10.2022 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the allegation in the FIR being general and omnibus in nature, the petitioner being the father-in-law of the deceased, the petitioner being in custody for about 7 months since 18.10.2022, charge sheet having been submitted in the case and his not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Bhangaha P.S. Case no. 65 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bettiah, West Champaran.
