JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-07-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 353, 332, 337, 427, 504, 506, 171(G), 307 of the Indian Penal Code and Section 135(K) of the Representation of Peoples Act.

The prosecution case as per the written report of the informant Dr. Dinesh Kumar Singh is that during assembly election in Rajgir, he was on patrolling duty on booth Nos. 169, 170 and 173 when 150 people came and made an attempt to caste bogus votes and thereby obstructed the poling process. The village Chaukidar subsequently disclosed the name of four persons including the petitioner as part of the mob.

It is submitted by learned counsel for the petitioner that accusation is against the mob and maliciously

Moreover similarly situated co-accused have been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 9855 of 2016. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao P.S. Case No. 171 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
