08-04-2016 Heard Sri Ratanakar Jha, learned counsel for the petitioner, learned A.C. to Govt. Advocate - 13 as well as learned counsel, who has appeared on behalf of respondent no. 4 & 5/Central Selection Board (Constable Recruitment). In the present writ petition, the petitioner has prayed for quashing of the result of constable recruitment, which was published, pursuant to Advertisement No. 2 of 2009. It has been claimed that the petitioner had participated in the selection process, however; he has not been shown selected, whereas, in the counter affidavit, a specific stand has been taken, particularly in paragraph - 17 that the petitioner was from the category of Extremely Backward Class Male Non Home Guard
Patna High Court CWJC No.17439 of 2011 (4) dt.08-04-2016 2/2 and he had secured much lesser marks than the last recommended candidate in his category. The petitioner has secured only 60 marks, whereas, the cut off marks in his category is 66. No reply to the counter affidavit has been filed.
In view of facts stated in paragraph - 17 of the counter affidavit, there is no ground for passing any favourable order.
The writ petition stands dismissed.
