Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 323 and 354(B) of the Indian Penal Code and Section 8 of the POCSO Act, registered in connection with Complaint Case No. 31 of 2020/Tr.No.05 of 2021.

Patna High Court CR. MISC. No.25003 of 2022(2) dt.13-10-2022 2/3 As per allegation, the petitioners misbehaved with the minor daughter of the informant. They assaulted her and petitioner no.1 snatched the mobile set from her person. The learned counsel for the petitioners has submitted that both the parties are agnates and there is previous dispute between them. Prior to filing of this case, BLDR Case No. 05/2017-18 was pending between the parties and much prior to the present occurrence in year 2015, the prosecution side had lodged a case against the defense side. He has submitted further that both the petitioners are students.

It appears that there is previous dispute between the parties. The defense side has also lodged Baruraj P.S.Case No. 36 of 2016 against the members of the prosecution side. Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned ADJ-VII-cum-Special Judge, POCSO Act, Muzaffarpur in connection with Complaint Case No. 31 of 2020, Tr.No. 05 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
