The petitioner apprehends his arrest in connection with Mansi P.S. Case No. 62 of 2016 registered under Section 366(A)/34 of the Indian Penal Code pending in the court of Chief Judicial Magistrate, Khagaria.
The accusation is of kidnapping of Pusplata Kumari, daughter of informant, by five persons including petitioner. Learned counsel for the petitioner submits that, in fact, there was love affair between the victim and co-accused, Arbind Kumar and only to give undue pressure petitioner has falsely been implicated in this case.
On the other hand, learned counsel for the informant
Patna High Court Cr.Misc. No.33263 of 2016 (2) dt.24-08-2016 submits that the victim has supported the prosecution case in her statement recorded under Section 164 of the Cr.P.C. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner.
