The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in Punpun P.S. Case No. 269 of 2015 instituted for the offences under Sections 147, 148, 149, 307, 506, 302 of the Indian Penal Code and 27 of the Arms Act. The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the petitioner is the main assailant. He is alleged to have fired upon the deceased which led to the death of the deceased. The post-mortem report also corroborated with the
Patna High Court CR. MISC. No.22226 of 2020(3) dt.07-12-2020 2/2 allegations made in the F.I.R.
A report was called for from the Trial Court. It has been reported that out of eight prosecution witnesses, six have already been examined and only two prosecution witnesses are remained to be examined. Due to Covid-19 Pandemic, the trial of the case has not been able to be concluded. Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial preferably within nine months from the date of receipt/production of a copy of this order.
